DIG VR Collector’s Edition Terms and Conditions

1. These Terms

These are the terms and conditions (Terms) that apply when you purchase the DIG VR Collector’s Edition from Wired Productions Ltd and related products through our website at wiredproductions.com (Site). These Terms also apply if you place your order through a physical location or any other place where orders may be placed.

These Terms may be updated periodically. Please review them each time you purchase from Wired Productions.

Ensure you read and understand these Terms before placing an order. It is recommended you retain a copy for future reference. These Terms explain our sales process, cancellation policies, additional products, and steps to take if there are issues with your Excavator.

2. Who Are We?

The Site is operated by Wired Productions Ltd., a company registered in England and Wales (Company No. 6593922), with our registered office located at Wired Productions, Unit 4, Watford Interchange, Colonial Way Watford, Herts, WD24 4WP.

3. Who is Selling You the Collector’s Edition?

Wired Productions Ltd. (Wired Productions, we, us) is the seller of the Excavator and will act as the supplier for the purchase.

4. The Agreement Between You and Us

When you confirm your purchase of a Excavator through our Site or another order method, you are placing an order (Order). The Order will confirm your details, the Purchase Price, and any applicable Admin Fees.

We will confirm acceptance of the Order via email. Upon sending this email, a legally binding agreement (Agreement) is formed between you and Wired Productions. This Agreement includes the Order and these Terms.

In cases where there is a discrepancy between the Order and these Terms, the Order will take precedence.

Occasionally, after accepting an Order, circumstances may arise that prevent us from fulfilling it. Examples include:

The DIG Excavator has already been sold to another customer, An error in price or description, or Reasonable grounds for suspecting potential fraud. If we cannot fulfil the Order, we will notify you via email and refund the Purchase Price.

5. Delivery and Collection

The buyer is to make their own arrangements for delivery or collection. The order will be ready to be collected six months from the date the order is made.

6. Refund Policy

Due to the custom nature of this product, we do not accept
returns or offer refunds once an order is placed and customisation work has
begun. The Item is made to the specific requirements. We encourage customers to
review their orders carefully before placing them to ensure complete satisfaction with the specifications. Once customisation has started, it is
considered a final sale, and the order cannot be cancelled or refunded.

7. Payment

A: Price and Payment Methods

The purchase price for the DIG Excavator (Purchase Price) is as stated at the time of Order and includes VAT.

Payment is due upon placement of your Order.

Any taxes or permits required for operating or transferring ownership of the DIG Excavator are the buyer’s responsibility.

B: Warranty

Wired Productions does not provide a manufacturer warranty or guarantee for the Excavator. Any existing warranties or guarantees from the original manufacturer may
no longer be valid, potentially affected by previous ownership or use.

If we possess any documentation, such as previous maintenance records, we will make a reasonable effort to pass this information to you, though we cannot guarantee its availability.

Wired Productions will not be liable for the validity or status of any manufacturer warranty on the Excavator.

8. Insurance

You must arrange your own insurance for the Excavator upon delivery or collection. Wired Productions does not provide or procure insurance services.

9. Summary of Your Legal Rights

We are legally obligated to supply products that conform to the Agreement and your rights under applicable law. This Agreement does not affect your statutory rights, and we recommend you contact your local Citizens Advice Bureau for further information on your rights.

10. Data Protection

11. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury due to our negligence, fraud, or any liability that cannot be excluded or limited by law.

We will not be liable for indirect or consequential losses, including loss of income, business, profits, or anticipated savings.

Subject to the above, our maximum liability under this Agreement is limited to the Purchase Price.

12. Circumstances Outside of Our Control

We are not responsible for any delays or failures to perform the Agreement due to circumstances outside our control, including natural disasters, strikes, or other unforeseeable events.

If a delay occurs, we will inform you and make reasonable efforts to minimize it. You may choose to cancel the Order and receive a refund of any payments made if the delay is substantial.

13. Miscellaneous

If any part of this Agreement is deemed invalid or unenforceable, the remaining sections will remain in effect.

You cannot transfer rights or obligations under this Agreement without our written consent. We may transfer rights or obligations, provided this does not affect your rights under the Agreement.

The
Agreement constitutes the entire understanding between you and Wired
Productions regarding the purchase of the DIG Excavator.

These Terms are governed by English law, and any disputes will be resolved in the courts of England and Wales unless you reside in Scotland or Northern Ireland, in which case local courts may apply.
